Anti-discrimination laws and the Fair Work Act 2009 impose numerous restrictions on employment related decisions such as recruitment, promotion, transfer, termination and more recently, the way in which flexible work arrangements are managed. The laws also prohibit certain forms of conduct in the workplace. A failure to understand and manage these issues can result in liability for employers and employees. In addition, workplace harassment and bullying can pose serious threats to the health, safety and welfare of people in the workplace, thereby placing the employer in breach of OHS legislation. It is vital that preventable measures are taken to prevent adverse consequences.
