Work health and safety

The principles of work health and safety are enshrined in legislation within each Australian State and Territory. Employers have substantial duties under these laws to ensure the safety of people in the workplace, and substantial fines can be imposed for inadequate attention to workplace safety. Governments have shown that they are willing to see these laws enforced.

A prosecution can be distressing for any employer, particularly for employers who are uncertain of their rights. Fortunately, Australian Business Lawyers & Advisors can help. Many employers faced with the prospect of prosecution have benefited from our knowledge of the prosecution process and the powers of the investigating authority.

We can assist in the preparation and presentation of a defence. If a defence is not available, we can assist you to present a plea to the court.

Our services are not limited to the defence of a prosecution. Through training and advice, we can assist you to understand your rights and obligations and those of others who come into the workplace, such as union officials and workplace inspectors.
